Welcome to QuestXP! By accessing or using our website, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time, and continued use constitutes acceptance of any changes.

2. Description of Service

QuestXP is a life leveling system that transforms your daily actions into quests, XP, and ranks. Our service includes:

• AI-powered quest generation and personalized goal tracking
• Experience points (XP) and level progression systems
• Timer-based missions for focused work sessions
• Statistics dashboards and progress tracking
• Achievement and ranking systems
• Mobile applications for iOS and Android

3. Eligibility

You must meet the following requirements to use QuestXP:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Comply with all local, state, and federal laws

Users under 18 must have parental or guardian consent.

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

6. User Content and Data

You retain ownership of any content you create or upload ("User Content"). By using QuestXP, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and process your User Content solely to provide the Service.

6.2 Prohibited Content

You may not post or share content that:

• Is illegal, harmful, or offensive
• Infringes intellectual property rights
• Contains personal information of others
• Is fraudulent or misleading
• Violates our community guidelines

7. Intellectual Property Rights

The Service, including all content, features, and functionality, is owned by QuestXP and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works without our express written permission. The QuestXP name, logo, and all related marks are our trademarks.

8. Payment and Subscriptions

8.1 Free and Premium Tiers

QuestXP offers both free and premium (paid) subscription tiers. Premium features may include advanced analytics, unlimited quests, and additional customization options.

8.2 Billing

Premium subscriptions are billed:

• Monthly or annually, as selected
• Automatically until cancelled
• In advance at the start of each billing period

8.3 Refunds

All subscription payments are non-refundable. You may cancel your subscription at any time to avoid future charges, but no refunds will be provided for the current billing period.

9. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE:

• Uninterrupted, secure, or error-free
• Free from viruses or harmful components
• Accurate, reliable, or complete
• Available at all times

QuestXP is a productivity tool and NOT a substitute for professional advice, including medical, financial, or therapeutic guidance. Always consult qualified professionals for serious matters.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUESTXP AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Service interruptions or data loss
• Third-party actions or content
• Unauthorized access to your account

Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless QuestXP, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights.

12. Dispute Resolution

12.1 Informal Resolution

If you have a dispute, please contact us first at support@questxp.app. We'll try to resolve it informally.

12.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. You waive your right to a jury trial and class action lawsuits.

13. Termination

You may terminate your account at any time by:

• Using the account deletion feature in settings
• Contacting support at support@questxp.app

We may suspend or terminate your access immediately for Terms violations, fraudulent activity, or any other reason. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Service.

15. Governing Law
